The organization of the Paris 2024 Olympic and Paralympic Games was an exceptional event for France and Paris, offering worldwide visibility through the images broadcast. This media impact is expected to generate positive medium-term repercussions.

However, while many were hoping for record visitor numbers linked to the arrival of the 11 million tourists expected in the capital, these forecasts did not always materialize for retailers present in the vicinity of the competition venues.

Against this backdrop, a commission has been set up dedicated to claims for compensation for economic damage suffered by professionals and linked to State decisions taken to ensure the organization of the Paris 2024 Olympic and Paralympic Games

Which losses are concerned?

Only economic losses directly linked to restrictive decisions taken by the State are eligible for compensation.  These losses must be certain and actual (and therefore not merely expected or discounted), special (i.e. concerning certain professionals directly affected by the traffic restrictions and not an entire profession) and, lastly, sufficiently significant in terms of reduced sales in particular.

The doctrine rules out compensation for indirect damage, such as the spontaneous closure of businesses in the vicinity of affected sites.

What kind of compensation?

Given the current state of the literature, it would appear that the awarding of compensation is fairly uncertain:

The president of the commission will issue an opinion on each individual case after analysis and consultation with the representative of the ministerial administration responsible for issuing the restrictive measures (either the Ministry of the Interior in most cases, or the Ministry of Transport in the case of river issues) and the representative of the professional sector concerned.

After giving her opinion on the request for compensation made by the professional who considers that he has suffered a loss, the president of the commission may propose an amount of compensation to the competent central administrations, i.e. those in whose name the traffic restriction measures were taken.

These authorities will then decide whether to pay compensation.
